Failure to submit the required recertification within the designated 90 day timeframe can lead to heavy daily fines, building evacuation, & legal proceedings. The property will be referred to the Unsafe Structures Section, initiating an enforcement case. This process involves continuous monitoring, including designating the building as unsafe, issuing a Notice of Violation, and a referral to the Unsafe Structures Board. The Board’s order timeline for compliance and repairs, potential orders to vacate, and enforcement cost collections are all part of this stringent process.

The recertification inspection involves a thorough evaluation of the structure’s structural and electrical components that must be conducted by a licensed Professional Engineer. The specific requirements can vary depending on the county in which your building is located. For instance, in Miami-Dade County, building recertification must include an illumination study and guard rail assessment. Furthermore, a new component was integrated into the inspection known as the Infrared Thermography Inspection.

Buildings with electrical systems (or main breaker) exceeding 400 amps are now required to provide supplementary thermal assessments conducted by a certified Level II Thermographer.

If concerns about the structural integrity of a building arise, whether or not it’s related to the recertification process, property owners and condominium associations should take proactive steps. Engaging a structural engineer to perform a comprehensive structural inspection is a prudent measure to ensure the integrity of your building.

If you’re facing problems with your homeowners association (HOA) or management company failing to fulfill the recertification process, you can report your concerns to the Department of Business and Professional Regulation (DBPR) – Division of Condominiums, Timeshares and Mobile Homes. Additionally, involving a structural engineer could provide valuable assistance. Structural engineers can thoroughly assess the building’s structural integrity, identify potential hazards, and offer expert recommendations. Their insights can play a pivotal role in advocating for the necessary maintenance and ensuring the safety of occupants and the property.

If the report indicates that repairs are required, proper permitting procedures must be followed before the building can be recertified. A licensed Professional Engineer must oversee and approve the repair process to ensure it meets the necessary safety and building code standards. This comprehensive approach guarantees that the building’s structural integrity is restored and compliant with regulations, safeguarding the occupants and property.

For buildings classified as threshold buildings, which are buildings 3-stories or taller or 50 feet in height OR a building having an assembled occupancy that exceeds 5,000 sqft. and has an occupancy of over 500 people, inspections must be conducted by a qualified Special Inspector, who is typically also a licensed structural engineer. The electrical portion must be completed by a licensed electrical engineer. This approach ensures that the inspections are carried out by professionals with the expertise to assess structural and electrical components effectively, ensuring building safety and compliance.
